Welcome to Themezz. These Terms of Service ("Terms") govern your use of the Themezz mobile application (the "App") operated by Themezz ("we," "us," or "our"). By downloading, installing, or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Platform-Specific Terms
- Apple App Store: If you downloaded Themezz from the Apple App Store, your use of the App is also governed by Apple's Standard Licensed Application End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula.
- Google Play Store: If you downloaded Themezz from the Google Play Store, your use of the App is also governed by the Google Play Terms of Service, available at play.google.com/about/play-terms.
These platform-specific terms supplement and do not replace these Terms of Service.
2. Eligibility
You must be at least 13 years of age (or the applicable minimum age in your jurisdiction) to use the App. By using the App you represent that you meet this requirement.
3. Accounts
You may register using an email address or through Apple or Google sign-in. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use.
4. Subscriptions & Payments
Themezz offers premium access through auto-renewing subscriptions billed via the Apple App Store or Google Play Store. By subscribing you authorize the applicable store to charge your payment method at the price displayed at the time of purchase.
- Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current billing period.
- You can manage or cancel your subscription through your device's subscription settings (Apple: Settings → Apple ID → Subscriptions; Android: Play Store → Subscriptions).
- Refunds are handled by Apple or Google in accordance with their respective refund policies.
- We reserve the right to change subscription pricing. Any price change will take effect at the start of your next billing cycle after notice.
5. Free Trial
If a free trial is offered, it will be clearly stated at the time of sign-up, including its duration. At the end of the trial period your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.
6. Content
All content available through the App — including trend reports, summaries, insights, and analysis — is provided for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of any content.
- Content should not be relied upon as professional, financial, medical, or legal advice.
- Content is owned by Themezz or its licensors and is protected by copyright and intellectual property laws.
- You may share individual reports through the App's built-in share feature for personal, non-commercial use.
- You may not systematically download, scrape, reproduce, or redistribute App content without our written permission.
7. Custom Topics
The App allows you to create custom topic keywords to personalize your feed. You agree not to use this feature to submit offensive, abusive, or harmful content. We reserve the right to filter or reject keywords that violate our content policies.
8. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the App's operation or infrastructure
- Reverse-engineer, decompile, or disassemble any part of the App
- Use automated tools, bots, or scrapers to access the App or its content
- Submit malicious input through any user-facing text field (including feedback forms and custom topics)
9. Intellectual Property
The App, its design, code, branding, and all content are the property of Themezz or its licensors. The Themezz name, logo, and related marks are our trademarks. Nothing in these Terms grants you any right to use our trademarks or branding without our prior written consent.
10. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
11. Termination
We may suspend or terminate your access to the App at any time, without prior notice, if you violate these Terms or engage in conduct that we determine is harmful to other users or our services. You may request deletion of your account at any time at themezz.io/accountremoval.
12. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Themezz and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the App, regardless of the theory of liability. Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless Themezz and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Effective date" at the top of this page. For material changes, we will notify you through the App or by email. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of competent jurisdiction.
